Suele basarse en motivos de interés público o de seguridad nacional. El Presidente Nixon intentó acogerse a este derecho durante el escándalo de Watergate.

- El escándalo político que acarreó la dimisión del Presidente Richard Nixon en 1974. En 1972 miembros del Partido Republicano Republican Party intentaron robar información de las oficinas del Partido Demócrata Democratic Party, situadas en el edifico de Watergate en Washington DC. Nixon sostuvo que él lo ignoraba, pero el periódico The Washington Post y grabaciones de conversaciones telefónicas contribuyeron para probar que mentía. La terminación -gate, desde entonces se ha utilizado para crear nombres que hacen referencia a otros escándalos, p.ej. Irangate (la venta ilegal de armas en 1985, por parte de EEUU. El dinero proveniente de ellas era entregado a los Contras de Nicaragua).

- El Congreso es el organismo nacional legislativo de Estados Unidos. Se reúne en el Capitolio Capitol - The Capitol y está compuesto por dos cámaras, el Senado Senate y la Cámara de Representantes House of Representatives. Se renueva cada dos años y su función es elaborar leyes. Toda nueva ley debe ser aprobada primero por las dos cámaras y posteriormente por el Presidente President.
